Abstract

This study aims to analyze the implications of marriage registration procedures during the implementation of community activity restrictions (PPKM) in the perspective of Nusantara fiqh. This research is classified as literature research and uses content analysis, besides that, researchers also extract data by observ and interview parties directly related to the theme of this research. The results showed that the implications of marriage registration procedures during the PPKM period were the delay in marriage and unregistered marriages. If viewed from the perspective of Nusantara fiqh, this action is different from the act of delaying marriage, on the contrary, unregistered marriage cannot be justified. Because the essence of Islamic jurisprudence implements maqashid shari'ah in the form of preventing harm and realizing benefit. Postponement of marriage is seen as a form of applying maqashid shari'ah, while siri marriage is not only a form of disobedience to government regulations, this action will also have the potential to cause problems regarding the fulfillment of rights and obligations for households in the future.
