Abstract

This article examines the use of Artificial Intelligence (AI) in judicial decision-making from the perspectives of comparative law and maqāṣid al-sharīʿah. The rapid development of AI technologies has encouraged courts in various jurisdictions to adopt algorithmic tools for legal research, document analysis, case management, and decision support. While these technologies offer significant opportunities for improving judicial efficiency and consistency, they also raise concerns regarding judicial independence, transparency, accountability, and algorithmic bias. This study employs normative legal research using conceptual, statutory, comparative, and maqāṣid al-sharīʿah approaches. It analyses the experiences of Indonesia, Singapore, Estonia, China, and the European Union in integrating AI into judicial systems. The findings indicate that AI can contribute to faster and more efficient judicial processes when accompanied by adequate regulatory safeguards and human oversight. From the perspective of maqāṣid al-sharīʿah, AI utilization in judicial processes may promote public welfare (maṣlaḥah) through improved access to justice and procedural efficiency. However, the principles of justice (ʿadālah), protection of intellect (ḥifẓ al-ʿaql), protection of life (ḥifẓ al-nafs), and protection of property (ḥifẓ al-māl) require that AI remain a decision-support instrument rather than an autonomous decision-maker. The article proposes a maqāṣid-oriented regulatory framework for Indonesia based on human-centered AI, explainability, accountability, and judicial oversight. It further highlights the need for future empirical research examining judicial acceptance, public trust, and the practical implementation of AI-assisted decision-making within court systems.
